Aristotle offers a conception of the private and its relationship to the public that suggests a remedy to the limitations of liberalism today, according to Judith A. Swanson. In this fresh and lucid interpretation of Aristotle's political philosophy, Swanson challenges the dominant view that he regards the private as a mere precondition to the public. She argues, rather, that for Aristotle private activity develops virtue and is thus essential both to individual freedom and happiness and to the well-being of (...) the political order. Swanson presents an innovative reading of the Politics which revises our understanding of Aristotle's political economy and his views on women and the family, slavery, and the relation between friendship and civic solidarity. She examines the private activities Aristotle considers necessary to a complete human life--maintaining a household, transacting business, sustaining friendships, and philosophizing. Focusing on ways Aristotle's public invests in the private through law, rule, and education, she shows how the public can foster a morally and intellectually virtuous citizenry. In contrast to classical liberal theory, which presents privacy as a shield of rights protecting individuals from one another and from the state, Aristotle, Swanson argues, presents privacy as opportunity or duty to pursue excellence. She concludes that for Aristotle a regime can attain self-sufficiency only by bringing about a dynamic equilibrium between the public and the private. The Public and the Private in Aristotle's Political Philosophy engages both long-standing and contemporary debates surrounding the interpretation of Aristotle. We describe the ongoing citations to biomedical articles affected by scientific misconduct, and characterize the papers that cite these affected articles. The citations to 102 articles named in official findings of scientific misconduct during the period of 1993 and 2001 were identified through the Institute for Scientific Information Web of Science database. Using a stratified random sampling strategy, we performed a content analysis of 603 of the 5,393 citing papers to identify indications of awareness that the cited articles affected by (...) scientific misconduct had validity issues, and to examine how the citing papers referred to the affected articles. Fewer than 5% of citing papers indicated any awareness that the cited article was retracted or named in a finding of misconduct. We also tested the hypothesis that affected articles would have fewer citations than a comparison sample; this was not supported. Most articles affected by misconduct were published in basic science journals, and we found little cause for concern that such articles may have affected clinical equipoise or clinical care. The purpose of this study was to identify and describe published research articles that were named in official findings of scientific misconduct and to investigate compliance with the administrative actions contained in these reports for corrections and retractions, as represented in PubMed. Between 1993 and 2001, 102 articles were named in either the NIH Guide for Grants and Contracts (“Findings of Scientific Misconduct”) or the U.S. Office of Research Integrity annual reports as needing retraction or correction. In 2002, 98 of (...) the 102 articles were indexed in PubMed. Eighty-five of these 98 articles had indexed corrections: 47 were retracted; 26 had an erratum; 12 had a correction described in the “comment” field. Thirteen had no correction, but 10 were linked to the NIH Guide “Findings of Scientific Misconduct”, leaving only 3 articles with no indication of any sort of problem. As of May 2005, there were 5,393 citations to the 102 articles, with a median of 26 citations per article (range 0–592). Researchers should be alert to “Comments” linked to the NIH Guide as these are open access, and the “Findings of Scientific Misconduct’ reports are often more informative than the statements about the retraction or correction found in the journals. Background: Family members are often required to act as substitute decision-makers when health care or research participation decisions must be made for an incapacitated relative. Yet most families are unable to accurately predict older adult preferences regarding future health care and willingness to engage in research studies. Discussion and documentation of preferences could improve proxies' abilities to decide for their loved ones. This trial assesses the efficacy of an advance planning intervention in improving the accuracy of substitute decision-making and increasing (...) the frequency of documented preferences for health care and research. It also investigates the financial impact on the healthcare system of improving substitute decision-making.Methods/DesignDyads (n = 240) comprising an older adult and his/her self-selected proxy are randomly allocated to the experimental or control group, after stratification for type of designated proxy and self-report of prior documentation of healthcare preferences. At baseline, clinical and research vignettes are used to elicit older adult preferences and assess the ability of their proxy to predict those preferences. Responses are elicited under four health states, ranging from the subject's current health state to severe dementia. For each state, we estimated the public costs of the healthcare services that would typically be provided to a patient under these scenarios. Experimental dyads are visited at home, twice, by a specially trained facilitator who communicates the dyad-specific results of the concordance assessment, helps older adults convey their wishes to their proxies, and offers assistance in completing a guide entitled My Preferences that we designed specifically for that purpose. In between these meetings, experimental dyads attend a group information session about My Preferences. Control dyads attend three monthly workshops aimed at promoting healthy behaviors. Concordance assessments are repeated at the end of the intervention and 6 months later to assess improvement in predictive accuracy and cost savings, if any. Copies of completed guides are made at the time of these assessments.DiscussionThis study will determine whether the tested intervention guides proxies in making decisions that concur with those of older adults, motivates the latter to record their wishes in writing, and yields savings for the healthcare system.Trial RegistrationISRCTN89993391. The Lacanian concept of fantasy is an essential locus for the conception of subjectivity and reality in the work of Slavoj Žižek, particularly in his initial English texts from 1989–2002. Whilst looked at creatively in its various guises and extended beyond clinical applications in his vast oeuvre – e.g. toward the exploration of the social, in terms of ideological fantasy foremost, to fuller elaborations in The Plague of Fantasies and beyond – the conceptual heritage is in need of fleshing out (...) within contemporary scholarship. To this end, and as part of a larger project currently underway, in the following we will trace the somewhat staggered development of the concept of fantasy in Lacan's initial meetings held at le Centre hospitalier Sainte-Anne between 1953 and 1961 where 'fantasy' as subjective component was truly born. Ultimately, the understanding of this trajectory and the changing significations involved in conceptual evolution can broaden our insight into Lacan's theoretical methodology as well as their insistence on retaining the category of subject in the philosophical tradition. Scientific models share one central characteristic with fiction: their relation to the physical world is ambiguous. It is often unclear whether an element in a model represents something in the world or presents an artifact of model building. Fiction, too, can resemble our world to varying degrees. However, we assign a different epistemic function to scientific representations. As artifacts of human activity, how are scientific representations allowing us to make inferences about real phenomena? In reply to this concern, philosophers of (...) science have started analyzing scientific representations in terms of fictionalization strategies. Many arguments center on a dyadic relation between the model and its target system, focusing on structural resemblances and “as if” scenarios. This chapter provides a different approach. It looks more closely at model building to analyze the interpretative strategies dealing with the representational limits of models. How do we interpret ambiguous elements in models? Moreover, how do we determine the validity of model-based inferences to information that is not an explicit part of a representational structure? I argue that the problem of ambiguous inference emerges from two features of representations, namely their hybridity and incompleteness. To distinguish between fictional and non-fictional elements in scientific models my suggestion is to look at the integrative strategies that link a particular model to other methods in an ongoing research context. To exemplify this idea, I examine protein modeling through X-ray crystallography as a pivotal method in biochemistry. (shrink)

This article seeks to identify and address the normative void that resides at the heart of postmodernist-feminist theory, and to propose a philosophical framework – beyond postmodernism, but incorporating its central insights – for thinking through the normative questions with which feminists are inevitably confronted in their engagements with positive law. Two varieties of postmodernist-feminism are identified and critically analysed: the ‘corporeal feminism’ of Elizabeth Grosz and Judith Butler, which seeks to ground feminist critical practice in the irruptive capacities (...) of the material body considered as an arte fact of social construction; and the deconstructionist feminism of Drucilla Cornell, for whom ‘the feminine’ is an indeterminate but disruptive force beyond its construction in law and in other social sites. The first component of the argument elaborated here is that each of these approaches ultimately reduces to a form of aestheticism which is incapable of generating a worthwhile and workable feminist approach to the restructuring of politics and law. The second component of the argument involves a return to aesthetics, in particular to the philosophical aesthetics of Kant’s Critique of Judgement. Kant’s aesthetic philosophy, it will be suggested, yields a framework of concepts which, duly re-manipulated, could speak to the very concerns that have inspired postmodernist-feminism: how to attend to (bodily) particularity while avoiding the dangers associated with ‘essentialism’; and how to theorise the propensity of the unrepresentable power of the feminine to exceed both embodied human capacities and the confining rein of socially privileged rationalities. Crucially, however it also responds to a set of preoccupations – those of the feminist lawyer – that cannot be accommodated by postmodernism: how to translate embodied experience into (legal) norms; generalise from the particular; seek consensus; and codify an endless potentiality in the form of law. “Humanism” is a term that has designated a remarkably disparate set of ideologies. Nonetheless, strains of religious, secular, existential, and Marxist humanism have tended to circumscribe the category of the human with reference to the themes of reason, autonomy, judgment, and freedom. This essay examines the emergence of a new humanistic discourse in feminist theory, one that instead finds its provocation in the unwilled passivity and vulnerability of the human body, and in the vulnerability of the human body to suffering (...) and violence. Grounded in a descriptive ontology that privileges figures such as exposure, dispossession, vulnerability, and “precariousness,” this new humanism is a corporeal humanism. This essay probes both the promise and the limitations of this emergent humanism with particular reference to recent work by feminist philosophers Judith Butler and Adriana Cavarero. (shrink)

Reading, a micro-level and subjective activity, is a mechanism through which gender is constructed and reinforced. Drawing on insights from cultural studies and feminist literary critics, and applying sociological perspectives and methodologies, we explored how 53 women and men read and interpreted two short stories, William Faulkner's “A Rose for Emily” and Jayne Anne Phillip's “Home.” We found that the gender of the readers had relatively few effects on their interpretations, but that indicators of life experience were influential. In general, (...) more substantial life experience as reflected in greater age, being married, and having children was associated with more sympathetic, empathic reactions to the major characters. Ideological positions also influenced readers' interpretations, when those positions were relevant to the themes of the text; these individual values and attitudes were associated with more particularistic patterns of empathy. Rather than dismissing gender as an influence on reading, however, we suggest that gender influences reading and interpretation partially through the pervasive gender-markings of social context. How does an object persist through change? How can a book, for example, open in the morning and shut in the afternoon, persist through a change that involves the incompatible properties of being open and being shut? The goal of this reader is to inform and reframe the philosophical debate around persistence; it presents influential accounts of the problem that range from classic papers by W. V. O. Quine, David Lewis, and Judith Jarvis Thomson to recent work by contemporary (...) philosophers. The authors take on the question of persistence by examining three broad approaches: perdurantism, which holds that change over time is analogous to change over space; exdurantism, according to which identity over time is analogous to identity across possible worlds; and endurantism, which holds that ordinary objects persist by enduring. Each of these approaches appears to be coherent, but each also has its own metaphysical problems. Persistence includes papers that argue for perdurantism, exdurantism, or endurantism, as well as papers that explore some metaphysical difficulties challenging each account. Through case studies of these writers' work, Rothenberg illuminates how this new theory calls into question currently accepted views of social practices, subject formation, democratic interaction, hegemony, political solidarity, revolutionary acts, and the ethics of alterity. Finding a common (...) dissatisfaction with the dominant paradigms of social structures in the authors she discusses, Rothenberg goes on to show that each of these thinkers makes use of Lacan's investigations of the causality of subjectivity in an effort to find an alternative paradigm. Labeling this paradigm 'extimate causality', Rothenberg demonstrates how it produces a nondeterminacy, so that every subject bears some excess; paradoxically, this excess is what structures the social field itself. Whilst other theories of social change, subject formation, and political alliance invariably conceive of the elimination of this excess as necessary to their projects, the theory of extimate causality makes clear that it is ineradicable. To imagine otherwise is to be held hostage to a politics of fantasy.
